The GODZILLA GUESS AND WIN Sweepstakes Official Rules (“Official Rules”)
no purchase necessary to enter or win

The Godzilla Guess and Win Sweepstakes (the “Sweepstakes”) is offered by Atari, Inc., 417 5th Ave, New York, NY 10016) (“Sponsor”). 
Participation in the Sweepstakes constitutes each entrant’s full and unconditional agreement and acceptance of these Official Rules including the decisions of the Sponsor, which are final on all matters relating to the Sweepstakes and cannot be appealed.

1. Who Can Enter: The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia who at the time of entry have reached the age of majority in the state in which they reside. Proof of residency and age may be required.  Employees of Sponsor, and each of its respective parent companies, subsidiaries, affiliates, divisions and advertising/promotional agencies, agents and contractors and immediate family members (defined as parents, spouse, children and their spouses, siblings and their spouses) of each of the above, together with those persons with whom such employees are domiciled, are not eligible to enter. Void outside of the fifty (50) United States, the District of Columbia and where prohibited by law. All federal, state and/or local laws, rules and regulations apply.

2. Sweepstakes Dates: The Sweepstakes begins at 12 AM Eastern Time (“ET”) on 11/29/07 (the “Start Date”) and ends at 12 PM  ET on 12/03/07 (the “End Date”). The period between the Start Date and End Date is known as the “Sweepstakes Period.” Sponsor’s clock shall be the official timekeeper for the Sweepstakes.

3. How to Enter: “To enter online, go to www.atari.com/contests/godzilla   to locate the link to the Sweepstakes entry form. Click on “Enter Sweepstakes” and follow the instructions to complete and submit the electronic entry form presented.” Each entrant must provide his/her name, date of birth, street address, phone number (with area code) and email address. "Maximum amount of entries per person is equal to one"

4. Restrictions: The following are prohibited and will result in automatic disqualification from the Sweepstakes: (1) entering the Sweepstakes under more than one email address; (2) entering the Sweepstakes more than once; (3) viewing or tampering with the Sponsor’s communications and/or computer systems, source code or data; (4) using any method that artificially increases entrant’s odds of winning; (5) non-compliance with these Official Rules; and (6) any other act which the Sponsor determines, in its sole discretion, jeopardizes the integrity of the Sweepstakes. In the event of a dispute as to the identity of a winner, such winner will be deemed to be the person in whose name the e-mail account associated with the provided e-mail address is opened at the time of entry. Each entry must be submitted separately. Limit one (1) person per e-mail address. Photocopies, mechanically reproduced or computer generated entry forms and entries (except as permitted in these Official Rules) are ineligible and may be disqualified. Sponsor is not responsible for lost, late, misdirected, illegible, incomplete, mutilated or stolen entries, or mail; printing errors appearing on the entry form, within these Official Rules, in any Sweepstakes related advertisements or other materials; or other errors of any kind whether mechanical, human, electronic or otherwise. Entries that are late, illegible, incomplete, unreadable, damaged, destroyed, delayed, lost, tampered with, incomprehensible, forged, mutilated, misdirected, inaccurate, unintelligible or otherwise not in compliance with these Official Rules will be disqualified. All entries generated by a script, macro or other automated/repetitive electronic means (except as permitted in these Official Rules) will be disqualified and ineligible for the Sweepstakes. All requested information on the entry form or piece of paper must be provided in English to enter and be eligible. All entries become the property of Sponsor and will not be acknowledged or returned.

Limit 1 prize per person/household. Each prize must be accepted as awarded and is not transferable to cash. Sponsor reserves the right to make prize substitution of equivalent kind and value if a prize is unavailable or cannot be awarded for any reason. Each winner is responsible for costs and expenses associated with acceptance and use of his/her prize (including, but not limited to, meals, ground transportation, gratuities and incidentals) not explicitly set forth herein as being awarded. All prizes are subject to availability. “Guest of each winner must be 17 or older” and/or “If a guest of a winner is a minor under applicable state or provincial law, then the winner or another guest of that winner must be the parent/legal guardian of such minor guest.” Each winner is solely responsible for the reporting and payment of any applicable federal, state and/or local taxes on his/her prize. The values of the prizes set forth above represent Sponsor’s good faith determination of the ARVs thereof and the actual fair market value, as ultimately determined by Sponsor, cannot be challenged or appealed. In the event the ARV of a prize is more than the actual retail value of that prize, the difference will not be awarded in cash.

6. Selection of Winners and Odds of Winning: Random drawings for all prizes will be made from all eligible entries received during the Sweepstakes Period, by the Sponsor at its offices, within 2 weeks of contest end date. Odds of winning a prize depend on the total number of eligible entries received.

7. Notification and Redemption: Sponsor will notify selected winners via email and/or phone on or about the drawing date. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. Sponsor is not obligated to leave voice mail, answering machine or other message. You must provide proof of identity (copy of Drivers License, Passport, or any other government issued photo I.D.) within ninety-six (96) hours of notification, or the prize will be forfeited. Proof must be provided either in person or via facsimile or courier. If a selected winner (i) fails to provide proof of identity, (ii) is found to have violated the rules of the Sweepstakes, (iii) cannot be reached within ninety-six (96) hours of an email being sent or telephone call being made to him/her, or a winner notification is returned as undeliverable, or (iv) declines or cannot accept, receive or use the prize for any reason, such selected winner will be deemed to have forfeited the prize in question. Sponsor (in its sole discretion) may hold a drawing for a new selected winner for the prize at issue and the first selected winner will be ineligible to claim such prize. Forfeited prizes may not be awarded. On or about the drawing date, each selected winner will be sent (via facsimile and/or other method determined in sole discretion of Sponsor) a declaration of eligibility together with a liability/publicity release for selected winner and his/her guest (“Declaration and Release”). Prior to awarding of any prize, winner and his/her guest must sign and return, within ninety-six (96) hours of receipt, the Declaration and Release confirming his/her compliance with these Official Rules and releasing the Sponsor, and its respective affiliates, subsidiaries, directors, officers, employees, agents and advertising/promotional agencies from and against any and all liability arising from the acceptance and use of any prize or, in Sponsor’s sole discretion, such winner’s prize may be forfeited and an alternate winner for that prize may be selected (in Sponsor’s sole discretion) in accordance with these Official Rules from among the remaining eligible entries. Sponsor reserves the right to modify the notification and Declaration and Release procedures in connection with the selection of alternate winner(s), if any. “Grand Prize will be shipped to winner by prepaid courier and winner may be required to sign a proof of delivery.”

8. General Terms and Conditions: This Sweepstakes is void where prohibited by law and is subject to all applicable federal, state and/or local laws, rules and regulations. Sponsor reserves the right, in its sole discretion, to terminate, modify or withdraw the Sweepstakes at any time, without prior notice. All taxes, fees and all other expenses and surcharges on prizes are the sole responsibility of each prize winner. Sponsor makes no representations or warranties regarding any awarded product or prize. By participating in the Sweepstakes, each participant agrees and acknowledges that the Sponsor and its respective parent companies, affiliates, subsidiaries, advertising/promotional agencies, fulfillment agencies and legal advisors and each of their employees, officers, directors, shareholders and agents (collectively the “Released Parties”) are not responsible for and shall not be liable for: (i) late, lost, stolen, delayed, misdirected, postage due, mutilated, incomplete, unreadable, inaccurate, garbled or unintelligible entries or notices; (ii) telephone system, facsimile, technical or computer malfunctions, lost connections or transmissions, disconnections or other errors of any kind whether mechanical, human, electronic or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes or the processing of entries; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses, costs, expenses or damages to person or property of any kind caused, in whole or part, directly or indirectly, by the prize or resulting from redemption, acceptance, possession, loss or use or misuse of any prize or from participating in the Sweepstakes or any Sweepstakes related activity; (v) inability to participate in the Sweepstakes; or (vi) any printing, typographical, human, administrative or technological errors in any material associated with the Sweepstakes. In the event more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Official Rules due to computer, printing, seeding, human or other error or problem, a random drawing will take place from among all eligible prize claims for the prize(s) at issue (or from among all persons so notified) to award the proper number of prizes as set forth in these Official Rules. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. No more than the number of prizes stated in these Official Rules will be awarded. Sponsor disclaims any liability for damage to any computer system related to or resulting from participating in, or accessing or downloading information in connection with the Sweepstakes.

SPONSOR RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO CANCEL OR MODIFY THE SWEEPSTAKES IF FRAUD, TECHNICAL FAILURES INCLUDING ANY NETWORK, SERVER OR HARDWARE FAILURE, OR ANY OTHER FACTOR BEYOND THE SPONSOR’S REASONABLE CONTROL IMPAIRS THE INTEGRITY OF THE SWEEPSTAKES AS DETERMINED BY THE SPONSOR IN ITS SOLE DISCRETION. IN THE EVENT OF SUCH IMPAIRMENT, SPONSOR RESERVES THE RIGHT BUT HAS NO OBLIGATION TO SELECT WINNERS AT RANDOM FROM ALL REMAINING ELIGIBLE, NON-SUSPECT ENTRIES RECEIVED PRIOR TO AND/OR AFTER SUCH IMPAIRMENT, OR IN SUCH MANNER AS DETERMINED FAIR AND APPROPRIATE BY SPONSOR IN ITS SOLE DISCRETION.

By entering the Sweepstakes, each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event will attorneys’ fees be awarded or recoverable; and (3) under no circumstances will any entrant be permitted to obtain any award for, and each entrant hereby knowingly and expressly waives all rights to seek, punitive, incidental or consequential damages and/or any other damages, other than actual out of pocket expenses, and/or any and all rights to have damages multiplied or otherwise increased. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, Sponsor determines entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives. Released Parties have not made and/or are not responsible for any misrepresentation or guaranty, express or implied, in fact or in law, relative to the prizes. The interpretation of these Official Rules shall be governed by the laws of the United States and the State of New York by and within the courts of that state.

9. Publicity: Acceptance of a prize constitutes permission by each winner for the Released Parties and any of their designees to use his/her name, likeness, voice, picture, biographical data, city name, comments and audio and/or video recording of him/her in any and all media now known or hereinafter devised, throughout the universe and in perpetuity, for the purpose of advertising and promoting the Sweepstakes or any other promotion, contest or sweepstakes sponsored by Sponsor, or for any other promotional purpose, except where prohibited by law. The name of each prize winner will be published on www.ataricommunity.com within 15 days of the prizes being awarded.

10. Winners List: The names of the winners, available after 12/6/07 and this copy of the complete Official Rules are available through http://www.atari.com/godzilla/contest Please specify “Winners List” or “Official Rules.”  Requests must be received by 12/12/2007.

11. Privacy: By entering the Sweepstakes, you grant the Sponsor permission to send Sweepstakes updates and winner notification, specials or promotions and/or newsletters/updates to you. You may at any time “opt-out” of receiving future mailings, and/or remove yourself from the Sweepstakes by clicking on “Remove.” Sponsor will be collecting personal data about you for the administration of the Sweepstakes and for purposes of market research. No such personal data will be transferred or sold to any third party except in the following circumstances:

12. Use of Data: Sponsor may match aggregated, statistical use information to parameters established by third parties, without releasing user personal information. This information will not contain any personally identifiable information. The Sponsor may share aggregate information with trading partners, co-branded sites, participating sponsors and advertisers; however, this aggregated information will not contain personally identifiable information. Any requests for access to the information you have supplied, or to update or rectify your information, must be made via email, accessible through www.atari.com/us/support
